  When Will The FDA React?                                  


One of the difficult parts about monitoring when the FDA will act on a product is determining when it’ll be enforced. Currently, the FDA plans to release PMTA decisions on a case-by-case basis. This means that products affected by FDA action will each have their own unique announcement as to whether their PMTA submission passes.



  Which Of My Inventory Is Protected?                 


The criteria for you to request a product refund is straightforward and simple.

The products in question must have been purchased within 30 days of the FDA’s announcement regarding an unsuccessful PMTA submission.


EXAMPLE: If a product is announced as failing its submission on November 1st, any stock purchased between October 1st - November 1st will be entitled to a full refund.




Terms of Service – Return and Refund Guarantee

At DemandVape, we are keenly aware of the difficulties presented to the industry by FDA’s premarket tobacco application (“PMTA”) process and the acceleration of the deadline for submission of PMTAs from August 2022 to September 9, 2020.  In order to provide assurances to our retailer customers that we stand behind our products, for all orders placed on or after October 1, 2020, we are offering a Return and Refund Guarantee, the terms of which are as follows:

1. Within one week of learning from any of our e-liquid suppliers that the PMTA for any bottled e-liquid product that we sell has been the subject of an adverse determination (i.e., refusal to accept, refusal to file, or no marketing order) from FDA, we will notify in writing those customers that have purchased that e-liquid product from us since October 1, 2020, of that determination.
               
2. Within fifteen (15) days of receiving a notification of an adverse determination on a PMTA for an e-liquid product from us, any customer who receives that notification may return to DemandVape any remaining inventory of the bottled e-liquid product that is the subject of the notification that the customer still has on hand, as well as documentation requested by DemandVape referencing the  order number for the original purchase(s) of the product by the customer.  The costs of shipping such returns to our facility in Buffalo, New York, will be the responsibility of the customer.  The return process must be coordinated through your account representative.
               
3. Within fifteen (15) days of receiving returned inventories of bottled e-liquid products that are the subject of an adverse determination by FDA, DemandVape will refund to the customer the amount of the original purchase price charged to the customer for the bottled e-liquid product that corresponds to the amount of the returned inventory.  No refunds will be provided for inventory that is not returned to DemandVape.
               
4. Unless otherwise agreed to in writing by DemandVape, no refunds will be provided for returns received more than fifteen (15) days after the date the notification of the adverse FDA action is sent to the customer by DemandVape.
               
5. This Return and Refund Guarantee does not apply to hardware, including coils, tanks, and batteries, or to pods, cartridges, or disposable devices.
               
6. This Return and Refund Guarantee is subject to revision or withdrawal by DemandVape at any time; provided, however, that the Return and Refund Guarantee will be honored for all purchase orders placed with DemandVape during the period while it was in effect.
